1st Gear’s Terms & Conditions of Training and Safety

C.B.T. & TRAINING

Please bring your own Helmet, Motorcycle Gloves, Jacket, Waterproofs, and Boots – sturdy boots (Not high healed or steel toe capped), Timberlands or similar that come to your ankle will be fine! You will need to bring your glasses if worn, as you will be required to read a number plate from 20.5 metres away. Please meet your instructor at our training site detailed on the attached directions.  If you are late to commence your training, NO REFUND WILL BE GIVEN. It is at the instructor’s discretion if you can commence your training – if the instructor feels that your safety and the safety of others would be at risk, i.e., fail the eyesight test, on medication that may disrupt your concentration or under the influence of drugs or alcohol – UNDER THESE CIRCUMSTANCES NO REFUND WILL BE GIVEN. 

Please bring your lunch and plenty of hot/cold drinks on the day.

Compulsory Basic Training can usually be completed in a day; however, you must complete each element successfully in turn.  If your trainer feels you require more training to achieve a satisfactory level of riding and demonstrate your potential safety on the motorcycle, you will be required to complete some additional training in one or more of the elements at a later date.  Everyone learns at different rates, it may take you one or more days to successfully complete your C.B.T., but please do not give up!  If you do not complete your C.B.T. on your first day, we will enter your training days and test days (as long as we have 3 clear working days before your module 1 and 2 Tests – We would then be able to enter your Module 1 and 2 Tests on hold) on hold until you have completed your C.B.T. – this will be an additional cost.

DRIVING LICENCE

WE NEED TO SEE THE CARD PART OF YOUR UK LICENCE AND CBT CERTIFICATE (IF YOU ARE NOT CONDUCTING THE CBT AS PART OF THE COURSE) ON THE FIRST DAY OF YOUR COURSE. IF YOU HAVE AN EU DRIVING LICENCE, YOU MUST BRING THE UK COUNTERPART THAT WAS ISSUED TO YOU BY THE DVLA AS WELL AS YOUR EU LICENCE – WE ARE UNABLE TO CONDUCT YOUR TRAINING IF YOU DO NOT HAVE A UK LICENCE OR UK COUNTERPART TO AN EU LICENCE.

IF YOU HAVE THE OLD-STYLE PAPER ONLY LICENCE, PLEASE BRING A VALID PASSPORT.

IF YOU DO NOT HAVE THE ABOVE THEN YOU WILL NOT BE ABLE TO CONDUCT YOUR COURSE, AND NO REFUND WILL BE GIVEN. PLEASE CHECK YOUR LICENCE IS STILL VALID – IF NOT, NO REFUND WILL BE GIVEN.

SPECIAL NEEDS: 

Please inform us via email if you have any special needs. This will help our instructors to adjust their teaching to suit your needs i.e. Hard of Hearing, Dyslexia, Autism, Asperger’s etc.

MEDICAL CONDITIONS:

Full disclosure must be made by the student, by email within 2 days of the date on your paperwork.  If you know of any drug/medical/medication condition (by prescription or otherwise) that could impair your riding ability, you MUST inform 1st Gear M.T.C. Please also inform your instructor on your arrival of your course. Failure to disclose any issues that become apparent to 1st Gear M.T.C instructors, will result in the termination of your training – NO REFUND WILL BE ISSUED.

VALUABLES AND PERSONAL PROPERTY: 

All personal property/vehicles are left on our site at the student’s own risk. 

CLOTHING WHILST TRAINING AND ON YOUR TEST: 

Your safety is our priority and therefore we reserve the right to cancel any course if a student is deemed as inappropriately dressed for the course.  In this event, the student will forfeit their fee.  You will need to bring appropriate clothing/safety equipment:  Helmet, Motorcycle Gloves, Substantial trousers (Jeans will be fine, just the thickest pair you have with no rips or holes), Long sleeved substantial jacket. You will need a pair of sturdy boots, they can be walking boots, Timberlands etc. that come to your ankle – NO steel toe caps or high heels. If you are wearing shorts, jogging bottoms, jeans with rips/holes, these WILL NOT BE ACCEPTED BY THE D.V.S.A. OR 1ST GEAR during training and your Module 1 and 2 Tests – This will result in your training/test being terminated and you will lose your training day/test fee.

 As you have booked your course with us, you will receive 10% discount at Infinity Clothing in North Camp!

PAYMENT & CANCELLATION: 

Deposits are non-refundable.  The balance of your course is payable the day before you start your training – We will call you to ask for your balance, as we do not store your card details. We also require 12 clear working days’ notice if you wish to change any of your dates or cancel your course.  A £50.00 administration charge will be deducted from any refund given. ON COMMENCEMENT OF YOUR COURSE NO REFUND WILL BE GIVEN.

Where there are unclaimed or outstanding training (including gift vouchers), these will remain valid for a period of 12 months.  NO REFUND will be given after the 12 months.

If you are ill and unable to attend any of your training, you will forfeit your training day/test fees.

A2 AND A TRAINING:  

The decision to upgrade you to a big bike, rests solely with your instructor. On rare occasions, students may not reach the level of skill required to upgrade to a bigger bike within the timescales of a normal course, or to complete the CBT. If such a situation the Chief Instructor will explain the alternatives to you.  Certain options may mean additional training or extra DVSA test costs to you and are subject to instructor availability, which is not guaranteed. NO REFUND WILL BE MADE IF YOU ARE NOT ABLE TO COMPLETE YOUR CBT, A2 OR A LICENCE. 1st Gear has the right to refuse training on a 300cc or 700cc motorcycle to students who are deemed as unsafe, due to lack of control or issues regarding the height or weight of the bike.  This will result in you taking your test on a 125cc bike. NO REFUND WILL BE GIVEN. Please be aware that the seat height of the bikes we use for the A Licence is 30inches/785mm. On attending your course, you automatically enter a bike hire agreement with 1st Gear Motorcycle Training Centre, which enables you to use the company’s vehicles on the road for your training accompanied by an instructor. Students will be liable and responsible for any traffic offence committed whilst riding 1st Gears bikes.

ABUSIVE BEHAVIOUR: 

1st Gear M.T.C does not tolerate abusive behaviour towards any member of staff, DVSA employee or other 1st Gear students.  Any student behaving in an abusive or disruptive manner will have their training terminated immediately.  They will leave the premises immediately and any incident may be reported to the police.  NO REFUND WILL BE GIVEN FOR ANY REMAINING TRAINING/TESTS.

1st GEAR’S EQUIPMENT/VEHICLES: 

1st Gear reserves the right to charge for damage to our vehicles and equipment that is caused by you – the student.  The student must pay for any damage to our bikes up to the first £300.00.  Parts are charged at retail price Inc. V.A.T., Labour is charged at £30.00 per hour. Any further training/tests may be cancelled without refund if payment is not made.1st Gear reserves the right to terminate training in the event of any student riding in a dangerous or negligent manner. Any student seen miss-using 1st Gear’s vehicles or equipment will have their training terminated – NO REFUND WILL BE GIVEN. 

TESTING ON YOUR OWN BIKE: 

On attending your course, you are confirming that your bike is road legal, you have valid insurance, a current MOT if applicable (If your bike is over 3 years old), and tax. Please make sure your bike is fitted with front and rear learner plates. All documents must be originals. It is your responsibility to ensure that your bike is suitable for test.  1st Gear will not accept responsibility if your test is cancelled by the D.V.S.A. If you are unsure that your bike is suitable for test, please contact the D.V.S.A. at technicalstandards@dvsa.gov.uk. 1st Gear and 1st Gear instructors will not be responsible for any loss or damage to your motorcycle/scooter or equipment whilst training with 1st Gear, and if your bike is stored at our training site.

MODULE 1 & 2 TESTS: 

Please make sure you bring the card part of your driving licence, C.B.T. Certificate, Module 1 Pass Certificate – this applies for the module 2 test only, Theory Test Certificate and *valid passport.  *Only required if you do not have a photographic licence.  Please ensure that all the expiry dates are correct on all your documents if you are unsure, please ask your instructor to check them.  Failure to have the correct documents on the day will result in your test being terminated and test fees forfeited. Any documentation must be the ORIGINALS. PLEASE ADVISE 1ST GEAR IF YOU ARE DYSLEXIC

We are unable to guarantee that your training and test will be conducted on the same bike; however, all efforts will be made to make this possible. 

If you fail the Module 1 Test, you can re-take it 3 clear working days later for £100 re-test fee, this includes:  Bike hire, insurance, petrol, an hour’s training before the test and test fee – we will give you the option to cancel your Module 2 Test if it is more than 3 clear working days away, so you will not lose the test fee – The Module 2 re-test fee is £180 this includes:  Bike hire, insurance, petrol, an hour’s training before the test and test fee – You can re-take your Module 2 Test 10 clear working days after taking your initial Module 2 Test.

If your test is terminated/cancelled by the examiner when you arrive at the Test Centre, you will be required to pay for any additional time with the instructor before your rescheduled test – Claim forms can be obtained from the D.V.S.A.

ON PASSING YOUR MODULE 2 TEST: 

On passing your Module 2 you will be asked if we can take a photo to use on our website, Instagram, or Facebook page.  Please inform your instructor if you do not wish to have your photo taken.

IF WE CANCEL YOUR TRAINING/TESTS:  

In certain circumstances 1st Gear M.T.C may have to postpone your course in full or part, due to weather conditions or if an instructor is ill, and unable to train you.  In such a situation, 1st Gear MTC will re-arrange your training and DVSA test date (if applicable) at a mutually agreed date.

INJURIES AND ACCIDENTS: 

You should understand that motorcycling can be dangerous and to undertake training at your own risk. 1st Gear cannot be held responsible for any injury during training – if you are injured during training, you will be required to sign an accident book. The student accepts responsibility for their own actions during the training and any possible injury caused to them during their motorcycle training. Any student that sustains injury during their training will have their training stopped.  1st Gear recommends in all cases, that injuries are checked by a medical professional immediately.

Personal insurance to cover cancellations, accident, or personal injury and/or loss of work or any other kind is the responsibility of the student.  1st Gear M.T.C. is under no circumstances liable.  1st Gear M.T.C. recommend students make their own arrangements for such if they feel it necessary to be covered.

COMPLAINTS AND APPEALS:  

We recognise that on occasion we may get it wrong…If for any reason you feel the need to complain, please speak to your instructor, if your instructor cannot resolve your complaint, please email the Chief Instructor, info@1stgearmtc.co.uk. Please allow 3 clear working days for a response. If you do not agree with the response from the Chief Instructor, then contact the DVSA at customerservices@dvsa.gov.uk.                     

DATA PROTECTION:

The information we hold for yourself, is for 1st Gear use ONLY and used in accordance with the Data Protection Act Principles. We use your driving licence number to name your Theory (If applicable), Module 1 and 2 Tests on the DVSA online booking system. Please read the D.V.S.A.’s fair processing notice:  www.gov.uk/government/publications/dvsa-privacy-notices/book-and-manage-your-driving-test-privacy-policy. On completion of your course your information is destroyed.
